Bennett's Landfill, located at 4399 Pinckney Road in Chester County, was a Class II landfill permitted by DHEC to accept construction and demolition debris, including some asbestos waste. Through various inspections of the site, DHEC learned that the landfill was not being operated in accordance with its permit and state regulations. On April 15, 2014, DHEC issued a Cease and Desist Order to the landfill as a result of lack of financial assurance , operating more acreage than allowed by its permit, and improper management of asbestos waste.

On January 29, 2015, DHEC filed in Chester County an action for enforcement and injunctive relief to compel both the Bennett's Landfill, Inc. (the landfill permit holder) and Crisis Hill, Inc. (the property owner) to permanently close the landfill. As of March 2015, the landfill permit holder had not closed the landfill or made efforts to put out the fire that had been burning at the landfill since November.

DHEC's pursuit of holding the landfill owner accountable for its obligations under the permit is ongoing. On April 28, 2015, DHEC filed an Order for Default Judgment against the landfill and landfill owner, ordering both to comply with the Cease and Desist Order , including proper closure of the landfill in accordance with all applicable regulations and the permit, and to pay DHEC $705,285.25 in fines and penalties.
