Philip Services Corporation (a/k/a ThermalKEM) Site--Response Costs

As of February 28, 2014, DHEC had incurred approximately $4.6 million in response costs, including site assessment and cleanup activities, identifying potentially responsible parties, public outreach, etc. So far, DHEC has been reimbursed approximately $3.1 million of past response costs through a settlement with the Philip Services Corporation (PSC) bankruptcy action. The bankruptcy court appointed Restoration & Redevelopment Solutions (R&R) as the custodial trustee to manage day to day operations at the Site and the custodial trust account, and to pay appropriate taxes, etc. The funds in the custodial trust account are nearly depleted. As such, DHEC is seeking a settlement with potentially responsible parties to fund and perform the final cleanup.
