Annual DHEC Regulation Development Report for Fiscal Year 2011 (July 23, 2010 - June 24, 2011) and Updated Listing of Department Regulations

The information provided in this annual report covers regulation development activity for the promulgation of the Department’s (DHEC) regulations subject to the provisions of the Administrative Procedures Act (APA) at S.C. Code Ann. Sections 1-23-10 et seq. for FY 2011 (July 23, 2010 through June 24, 2011).

All DHEC Notices of General Public Interest, Notices of Drafting, Notices of Proposed Regulations and Opportunity for Public Comment, and Notices of Final Regulations that were published in the South Carolina State Register (State Register),as well as ontheDepartment’s Regulatory Information website, are reported, along with the State Register volume, issue and date in which each was published. The State Register is published on the fourth Friday of each month for 12 months per fiscal year. For example: SR 34-7 means that the document was published in State Register Volume 34 Issue 7 on July 23, 2010. SR 35-6 means that the document was published in State Register Volume 35 Issue 6 on June 25, 2011.

This report also includes a listing of public hearings that were conducted by the Board of Health and Environmental Control pursuant to S.C. Code Ann. Section 1-23-111.

This report also provides a list of DHEC regulations that were submitted in FY 2011 for legislative review and are pending.

Additionally, this report provides an updated listing of all of the Department’s regulations and effective dates through June 24, 2011.

    Public Hearing: November 10, 2010. Based on public comments received during the public comment period and at the public hearing, the Board asked staff to re-examine the following issues: fees; define follow-up plan when evacuations take more than eight minutes, make fire safety requirements more availabl; and return to the Board with this information.

This listing of Department regulations below and effective dates is current through June 24, 2011, and supersedes any previous listing. Regulations can be changed any time of year by promulgation of an amendment or repeal, or by adding a new regulation subject to the provisions of the Administrative Procedures Act (APA) at S.C. Code Ann. Section 1-23-10 et seq. The most current version of a regulation is the valid version and would supersede any previous version.
