South Carolina 1997 8-Hour Ozone Attainment Demonstration
Charlotte-Gastonia-Rock Hill, North Carolina-South Carolina (Metrolina) State Implementation

On December 22, 2008, DHEC submitted a letter to EPA withdrawing its attainment demonstration for the York County portion of the Metrolina nonattainment area for the 1997 8-hour ozone NAAQS. DHEC found that after careful consideration of all options, it was in the best interest of all parties involved to withdraw the ozone attainment demonstration that was submitted in August 31, 2007. While EPA believed that it was unlikely that the Metrolina area would attain the 1997 ozone standard by its attainment date, DHEC believed that the region could meet the requirement for requesting a one-year extension if the attainment date was not met and believed that disapproval of the attainment demonstration SIP was premature. In its December 22, 2008 letter, DHEC committed to submit a revised attainment demonstration for South Carolina's portion of the Charlotte-Gastonia-Rock Hill, NC-SC by November 30, 2009.
On January 9, 2009, EPA sent a letter to South Carolina informing it that as a result of the withdrawal of its attainment demonstration, EPA would issue a Finding of Failure to Submit the attainment demonstration portion of the SIP. EPA also sent the Catawba Indian Nation a letter informing them of this pending EPA action. The Catawba Indian Nation has land that is included in York County, South Carolina, portion of the Metrolina nonattainment area.
In a Finding of Failure to Submit effective May 8, 2009, EPA announced that South Carolina and North Carolina failed to submit the required attainment demonstrations for the Metrolina nonattainment area.
On January 12, 2012, at the request of EPA Region 4, DHEC withdrew the attainment demonstration for the Metrolina nonattainment area except for the reasonable further progress plans and emissions inventories.
