Additional Criteria for Large Swine Facilities over
1,000,000 Pounds of Normal Production
The following criteria are applicable to large swine facilities with over 1,000,000 pounds. These criteria are in addition to the criteria that are applicable to all large swine facilities:
- the integrator is required to be a co-applicant and co-permittee;
- the facility owner is required to have an individual Concentrated Animal Feeding Operations NPDES permit before a state agricultural permit can be issued under SC Regulation 61-9;
- the applicant must notify all property owners and persons residing on property within 1 mile of the proposed facility that he will be applying for a permit from the Department;
- the applicant must hold at least one public meeting prior to the submission of an application. The meeting minutes and the opinions derived must be included with the submission of the application;
- the facility setbacks are:
- waters of the state (excluding ephemeral and intermittent; streams) - 2,640 feet (½ mile); However, if ORW, Critical Habitat for endangered species or shellfish harvesting waters, the setback is 3,960 feet (3/4 mile);
- real property or residence - 1,750 feet (can't be waived by property owner);
- potable well - 1,750 feet; and
- another swine facility with 1,000,000 pounds or more - 25 miles;
- the manure utilization areas (land where manure is spread) setbacks are:
- property line - 200 feet;
- occupied residence - 750 feet; and waters of the state, ditches, and swales - 150 feet;
manure utilization areas must have 3 ground water monitoring wells (1 up and 2 down gradient) in each drainage basin intersected by the utilization areas to be sampled as determined by the Department;
- Spray irrigation can not be used as the method of manure land application;
- Treatment systems must: be:
- lined with a geomembrane liner with a hydraulic conductivity of 5 x 10-7 cm/sec;
- not be open (uncovered) anaerobic lagoons;
- contain the 50 year, 24 hour storm event and maintain at least 2 feet of freeboard;
- use "Best Available Technology" - no consideration to cost;
- not exceed 1,000,000 cubic feet in volume for any single lagoon or storage pond;
- have an air permit for the emissions from covered lagoons;
- have automated water level monitoring devices;
- have 3 ground water monitoring wells (1 up and 2 down gradient) to be sampled quarterly; and
- be operated by an operator licensed by the SC Board of Environmental Certification;
Penalties must be assessed for breach of a treatment system or loss of containment, manure runoff from utilization areas, or discharge to ground water that causes a violation of water quality standards. Second offense of any these violations results in revocation of permit.
