Public Notice Requirements For New or Expanding Large
Swine Facilities with 1,000,000 or More Pounds
Permit Applicant Responsibilities.
The permit applicant prior to making an application for a permit will use the Department’s Notice of Intent to Construct an Agricultural Facility form to notify all property owners an persons residing on property within 5,280 feet of the footprint of the proposed facility. This notification will explain that an application will be made to the Department for a new or expanding agricultural facility. The completed forms are submitted to the Department.
The permit applicant will hold at least one public meeting on the proposed facility prior to the submission of an application to the Department
DHEC Responsibilities.
Application Received. When an application is received, DHEC will notify the public using the following methods:
- Placing a notice in a local newspaper;
- Sending a notice (using First Class US mail service) to the County Commissioner;
- Sending a notice (using First Class US mail service) to a Water Supply District with a potable intake downstream from the facility that may be affected; and
- Sending a notice to any person who asked to be notified.
Public Hearing. DHEC will hold a public hearing. The Department will notify the public on the date, time, and place of the hearing using the following methods:
- Placing a notice in a local newspaper;
- Notifying persons (using First Class US mail service) residing on adjoining property;
- Sending a notice (using First Class US mail service) to the appropriate County Commissioner;
- Sending a notice to the appropriate Water Supply District with a potable intake downstream from the facility that may be affected; and
- Sending a notice (using First Class US mail service) to any person who asked to be notified.
Permit Decision. When a permit decision is made, DHEC will notify the following persons using First Class US mail service:
- the permit applicant;
- persons who commented in writing;
- persons who attend the public hearing; and
- for permit issuances, place a notice of permit issuance in a local newspaper.
