Property Lines 500,001 to 750,000 lbs. - 1,000 feet
- 750,001 to 1,000,000 lbs. - 1,250 feet
- Distances may be reduced with permission from adjoining property owner
Separation from another large swine facility with less than 1,000,000 pounds - 2 miles
Waters of the State including ephemeral and intermittent streams - 100 feet (Setback for ephemeral and intermittent stream may be reduced if a permanent vegetative water quality buffer is provided)
Lagoons or Waste Storage Ponds
Wells
- Human Drinking Water Wells - 500 feet
- Animal Drinking Water Wells - 100 feet
Ditches except site drainage:
- which drain to waters of state excluding ephemeral and intermittent streams - 100 feet
- which drain to ephemeral or intermittent streams - 50 feet

- 750,001 to 1,000,000 lbs. - 1,250 feet
- Both distances may be reduced with permission from adjoining property owner.
Waters of the State
- Waters of the State excluding ephemeral and intermittent streams - 1,320 feet (if a fail safe design is utilized to prevent swine waste in the event of a lagoon failure from entering waters of the state (not including ephemeral and intermittent streams) the distance can be reduced to 500 feet. .However, if waters classified as ORW or Shellfish or waters are critical habitat of endangered species then 2,640 feet with no reduction for failsafe design.
- ephemeral and intermittent streams - 100 feet (maybe reduced 50 feet if a permanent water quality buffer at least 50 feet wide is provided)
Manure Utilization Areas
Wells
- Human Drinking Water Wells - 200 feet
- Animal Drinking Water Wells - 100 feet (per Reg 61-71)
Ditches:
- which drain to waters of state excluding ephemeral and intermittent streams - 100 feet
- which drain to ephemeral or intermittent streams - 50 feet
Residences/Property lines
- If injection is the method of application, no setback from residences or property line.
- If injection not used, 300 feet from the nearest residence. If no residence within 300 feet, no setback from the property line. Distance maybe reduced with consent of adjoining property owner.
Waters of the State
- Waters of the State excluding ephemeral and intermittent streams - 100 feet (regardless of method of application)
- ephemeral and intermittent streams and the method application is:
- spray irrigation -100 feet
- incorporation - 75 feet (can be reduced to 50 feet if incorporated within 24 hours)
- injection - 50 feet
