I. TITLE: Administrative Orders, Consent Orders, and Sanction Letters issued by HEALTH REGULATION (HR).

II. SUBJECT: Sanctions completed during the period July 1, 2010, through August 31, 2010.

III. FACT: For the period July 1, 2010 through August 31, 2010, Health Regulation issued twelve (12) Consent Orders with total penalties of $77,508.28.

IV. ANALYSIS:

  1. National Transport Ambulance Service, 113 Dixie Drive, Darlington, SC 29532. Under a Consent Order executed July 9, 2010, a monetary penalty of $500.00 was paid by the service. The service was found to have violated Regulation 61-7, Emergency Medical Services, for not having five (5) certified employees as required for licensure and submission of falsified documentation to the Department with regard to the employee roster.

  2. North Myrtle Beach Rescue Squad, 1002 6th Avenue S., North Myrtle Beach, SC 29597. Under a Consent Order executed July 30, 2010, a monetary penalty of $1,000.00 was paid by the service. The service was found to have violated Regulation 61-7, Emergency Medical Services, for placing an unpermitted ambulance into service without notifying the Department, insufficient equipment as required by Regulation and expired supplies in the unit.

  3. City of Hanahan Fire and EMS, 5826 Campbell Street, Hanahan, SC 29410. Under a Consent Order executed July 30, 2010, a monetary penalty of $500.00 was paid by the service. The service was found to have violated Regulation 61-7, Emergency Medical Services, by allowing an uncertified employee to perform patient care and serve as “primary care attendant.”

  4. The Town of Honea Path EMS, 6 Gaines Rd., Honea Path, SC 29654. Under a Consent Order executed August 31, 2010, a monetary penalty of $3,000.00 was paid by the service. The service was found to have violated Regulation 61-7, Emergency Medical Services, for operating two ambulances that were licensed to another provider number without Department authorization and were used for treatment and transportation of patients.

  5. Northern Anderson County EMS, 10703 Anderson Rd., Easley, SC 29642. Under a Consent Order executed August 31, 2010, a monetary penalty of $3,000.00 was paid by the service. The service was found to have violated Regulation 61-7, Emergency Medical Services, for operating an ambulance that was licensed to another provider number without Department authorization and was used for treatment and transportation of patients.

  6. Saluda County Ambulance Service, 581 Newberry Highway, Saluda, SC 29138. Under a Consent Order executed August 31, 2010, a monetary penalty of $500.00 was paid by the service. The service was found to have violated Regulation 61-7, Emergency Medical Services, by allowing an uncertified employee to perform patient care and serve as “primary care attendant.”

  7. Karan Hiatt, 1749 Ezell Rd., Chesnee, SC 29138. Under a Consent Agreement executed August 25, 2010, Ms. Hiatt’s Emergency Medical Technician-Paramedic Certificate, No. 011557, was suspended, and she was issued an Intermediate certification. The Department determined that Ms. Hiatt has failed to provide emergency medical treatment of a quality deemed acceptable. The medical control physician for her employer withdrew her advanced life support endorsement due to breaches in standing orders and poor documentation practices.

  8. Donna A. Greene, 2648 Crowders Creek Rd., Gastonia, NC 28052. Under a Consent Agreement executed August 25, 2010, Ms. Greene’s Emergency Medical Technician-Paramedic Certificate, No. 015588, was suspended, and she was issued an EMT-Basic certification for a period of no less than six (6) months. Ms. Greene was found to have committed misconduct by discontinuing patient care and allowing the patient to be driven home by her non-certified partner, and by falsifying documentation for an ambulance transport

  9. Country Grove Residential Care, 1382 Doctor Evans Rd., Moncks Corner, SC 29461. Under a Consent Order executed February 17, 2010, the facility paid $3,000 of a $9,300 monetary penalty, with $6,300 suspended due to closure of the facility. The facility was found to have repeatedly violated Regulation 61-84, Standards for Licensing Community Residential Care Facilities. Violations included caring for residents in excess of licensed capacity and repeat patient care violations to include: failure to develop Individual Care Plans, failure to have timely resident physical exams, and medication errors.

  10. Evelyn’s Residential Care, 162 South McQueen St., Florence, SC 29501. Under a Consent Order executed May 25, 2010, the facility paid $1,500 of a $21,800 monetary penalty, with $20,300 stayed upon one (1) year of substantial compliance. The facility was found to have repeatedly violated Regulation 61-84, Standards for Licensing Community Residential Care Facilities. Violations included medication errors, and failure to document required information in Individual Care Plans, initial training, tuberculosis testing, and physician orders.

  11. Bionomics, Inc., 1550 Bear Creek Rd., Oak Ridge, TN 37830. Under a Consent Order executed July 27, 2010, a civil penalty of $27,000.00 was paid by the company. The company was found to have violated Regulation 61-63, Radioactive Materials, for failure to obtain reciprocal/state recognition, failure to properly package radioactive waste materials so that radiation levels remained within regulatory limits, and failure to make necessary radiation surveys as required by regulation.

  12. Bon Secours St. Francis Xavier Hospital, 2095 Henry Tecklenburg Drive, Charleston, S.C. 29414. Under a Consent Order executed July 9, 2010, a monetary penalty of $37,508.28 was paid by the facility. The facility was found to have violated Regulation 61-15, Certification of Need for Health Facilities and Services, for changes to the project which resulted in a substantial increase in project cost.
