I. TITLE: Administrative Orders, Consent Orders, and Sanction Letters issued by HEALTH REGULATION (HR).

II. SUBJECT: Sanctions completed during the period October 1, 2010 through October 31, 2010.

III. FACT: For the period October 1, 2010 through October 31, 2010, Health Regulation issued four (4) Consent Orders with a total penalty of $77,425.

IV. ANALYSIS:

  1. Hampton Regional Medical Center, 595 West Carolina Avenue, Varnville, SC 29170. Under a Consent Order executed September 2, 2010, the Department imposed a $39,900 penalty, which will be stayed upon a period of twenty-four (24) months of satisfactory performance and compliance. The facility was found to have violated Regulation 61-15, Certification of Need for Health Facilities and Services, for changes to the project which resulted in a substantial increase in the approved Total Project Cost.

  2. East Cooper Diagnostic Imaging, LLC d/b/a Summerville MRI and Imaging, 595 West Carolina Avenue, Varnville, SC 29944. The facility is managed by MedQuest Associates, Inc. Under a Consent Order executed August 25, 2010, a monetary penalty of $30,000 was paid by the facility management company. The applicant further agrees in the future to file a formal request for a Notice of Applicability Determination from the Department concerning Total Project Cost should questions arise. The applicant was found to have violated Regulation 61-15, Certification of Need for Health Facilities and Services, for failing to obtain a non-applicability determination from the Department prior to initiating a service.

  3. Medical University of South Carolina Medical Center, 171 Ashley Avenue, Charleston, SC 29425. Under a Consent Order executed September 30, 2010, a monetary penalty of $3,025 was paid by the facility. The company was found to have violated Regulation 61-15, Certification of Need for Health Facilities and Services, for changes to the project which resulted in a substantial increase in the approved Total Project Cost.

  4. Ambunet, Inc, 1439 Johnsonville Hwy, Lake City, SC 29560. Under a Consent Order executed October 7, 2010, a monetary penalty of $4,500.00 was paid by the service. The service was found to have violated Regulation 61-7, Emergency Medical Services, for allowing uncertified personnel to perform patient care.
